By placing an order with Victoria Silver and Jewellery CC (“VSJ”) you are deemed to have read, understood and agreed to these terms and conditions. These terms and conditions are governed by South African law and you hereby agree to submit to the exclusive jurisdiction of the South African courts.

VSJ is domiciled and carries on business in South Africa, and makes no warranty to any persons who places an order from outside South Africa that this website complies with any non-South African laws or regulations.

1. Contract
   
   A contract will come into place when an order is placed by you and the order is confirmed and the goods are despatched by VSJ. Upon confirming your order your Credit Card will be charged and debited to the value of the goods that you have ordered.
   
   
2. Privacy
   
   
   1. VSJ shall take all reasonable steps to protect your personal information.
   2. VSJ may electronically collect, store and use your following personal information:
      1. name and surname;
      2. birth date;
      3. gender;
      4. country of residence;
      5. closest city;
      6. e-mail address;
      7. IP address; and
      8. ID number / passport number.
         
   3. VSJ collects, stores and uses the abovementioned information for the following purposes:
      1. to greet you when you access the VSJ website;
      2. subject to your consent, to inform you of facts relating to your access and use of the VSJ website;
      3. subject to your consent, inform you about competitions and special offers from VSJ, and/or its partners/affiliates;
      4. to verify your identity when transacting with VSJ; and
      5. to ensure that the goods are received by the addressee
         
   4. The information set out in paragraph 2.2 above is collected either electronically by using cookies or is provided voluntarily by you. You may determine cookie use independently through your browser settings.
      
   5. You may elect not to receive any communications from VSJ and/or its partners / affiliates. In the event that you wish not receive any communications from VSJ, please will you advise VSJ of same by selecting the “take me off your mailing list” tab
      
   6. VSJ may collect, maintain, save, compile, share, disclose and sell any information collected from you the User, subject to the following provisions:
      1. VSJ shall not disclose personal information from you unless you consent thereto;
      2. VSJ shall disclose information without your consent only through due legal process; and
      3. VSJ may compile, use and share any information that does not relate to any specific individual
         
   7. VSJ owns and retains all rights to non-personal statistical information collected and compiled by VSJ.
      
      
3. Prices and Availability of Goods
   
   
   1. All prices are quoted in South African Rand (ZAR). Persons domiciled or carrying on business within South Africa shall be obliged to pay VAT at the current rate of 14%. All prices quoted in ZAR are inclusive of VAT at the current rate of 14%. All persons domiciled outside South Africa shall not be required to pay the abovementioned VAT however, they will be obliged to pay for all costs relating to the delivery of the goods, which costs are equivalent to the 14% rate for VAT. Therefore, all prices quoted on the website are the actual prices which you will be obliged to pay. Any cost incurred in respect of customs, duties or levies pertaining to your destination country shall be your sole responsibility.
      
   2. Whilst VSJ makes every effort to ensure that prices and details are correct on this website, data entry errors and other technical problems may occur, which may result in inaccurate prices being shown. In such circumstances any excess amount paid by you will be refunded to you, and any outstanding amount in price shall remain owing by you to VSJ, of which, all outstanding amounts must be paid before the goods will be despatched.
      
   3. VSJ will inform you of any outstanding amounts within 14 (fourteen) working days of the order being placed. If you have any queries in regards to any price which you believe may be inaccurate then please contact us on info@victoriasilverjewellery.com.
      
      
4. Delivery and Charges
   
   Subject to the availability of stock, all goods ordered will be packed and sent by VSJ to you within 14 (fourteen) working days (stock availability permitting) by prepaid registered post (South Africa only) or by courier (International only). Upon despatching the purchased goods VSJ shall forward a waybill and/or tracking number to you via e-mail. Please note that a signature and valid identity document will be required for the collection/receipt of the goods purchased.
   
   
5. Ownership
   
   Ownership and all liabilities relating to ownership of the goods shall pass to you upon VSJ despatching the goods to you. No warranties in regards to the goods are made by VSJ. VSJ shall not be responsible for any loss or damage to the goods, incurred during the posting and delivery thereof.
   
   
6. Stock Availability
   
   
   1. VSJ aims to always have the goods displayed on this website in stock. Where any of the goods are no longer available and/or are sold out this will normally be indicated on this website.
      
   2. In the circumstances where an item is not available and VSJ have not indicted same on this website and an order has been placed by you, VSJ will inform you within 14 (fourteen) working days that the item in question is not available.
      
      
7. Return Policy
   
   
   1. Should you wish to return any of the goods you are required to do so within 7 (seven) days of collection of the goods. Goods must be returned complete, in perfect condition, unused, unaltered and in the original packaging. For reasons of hygiene, earrings cannot be returned.
      
      
   2. Making Returns
      
      1. All goods which are to be returned, must be sent to VSJ at the following address, and must be sent via prepaid registered mail:-

      2. VSJ shall not accept any responsibility for any loss or damage to the goods which occurs during the transportation thereof. Please note that any costs incurred in returning the goods shall be for your own account and shall not be refunded by VSJ.
         
      3. Should an item that has been sent to you be faulty then VSJ may reimburse you at its own discretion. Please note that no reimbursements will be made after the expiry of the 7 (seven) day period referred to in the above clause 7.5.
         
8. Payment and security
   
   
   1. VSJ currently accepts all Visa, Mastercards, American Express and Diner’s Club cards. All payments can be made on-line only.
      
   2. The purchase price of the goods shall be effected by an Electronic Fund Transfer system using a secure socket level (SSL), administrated by the Bankers of VSJ, and your order for the goods shall only be accepted by VSJ, once your payment for the goods order has been approved and accepted by the Bankers of VSJ.
      
      
9. Conformity of Goods
   
   The goods that are handcrafted are unique and accordingly these goods may vary slightly in shape, size and stone colour. The return of any handcrafted goods due to size and/or shape and/or stone colour, shall not be accepted by VSJ.
   
   
10. Disclaimer
    
    
    1. In the event that you decide to on-sell these products to third parties, VSJ expressly exclude themselves from such transactions and/or agreements.
       
    2. VSJ shall not be liable to you or be deemed to be in breach of this contract by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products ordered by you, in the event that the delay or failure was due to any cause beyond our reasonable control.
       
       
11. Copyright and Trademark
    
    
    1. All the intellectual property, including , inter alia, the Victoria Silver and Jewellery trade mark and logo, the pictures, designs, logos, photographs and written text belong to VSJ and VSJ reserves all its rights in regards thereto. The copying, modification, distribution, reproduction, or incorporation of the Intellectual Property shall be prohibited, save that you may:
       
    2. Copy, print or download extracts of the material on this website for the sole purpose of using this website to place an order with VSJ.
       
    3. Copy, print, or download material on this site for the purpose of sending to individual third parties for their personal information provided that you acknowledge VSJ as a source of the material and that you inform the third party that these conditions apply to them and that they must comply to them.
       
       
12. Limitation of Liability
    
    
    1. Notwithstanding anything to the contrary contained in these Terms and Conditions of Contract and Sale or elsewhere, the liability of VSJ, howsoever arising out of the agreement or in Delict or by operation of statute or otherwise, shall not extend beyond the obligations specifically assumed in terms of this clause 11 and VSJ:-
       
    2. gives no other warranties, express or implied, inclusive of but not limited to warranties in relations to workmanship, materials, fitness for purpose, merchantability or product liability, which are not set out hereunder, whether the particular purpose of the use be known to VSJ or not;
       
    3. shall in no event be liable to you for any loss of profit, loss of use, loss of production, loss of contracts, loss of custom, loss of goodwill, or any special, indirect or consequential damages of whatsoever nature and howsoever arising.
